long story short.
I moved out of a property in October 2011 and I was issued a CCJ from united utilities for £453 on 26th Feb 2012
I have contacted unitied utilities about this and i recieved a reply bt email stating that the amount they issued the ccj for was wrong and it should have been £396 and they have also removed the court costs and fees of £105 which brings the total down to £291. I have emails from a senior customer service manager at UU saying that if i pay the £291 i can apply to get the CCJ set aside and they will NOT contest it if i do and they will also send me a letter in the post when ive paid basically saying that i have paid the amount outstanding and that they wont contest the CCJ if i applied to have it removed.
I am planning on paying the £291 by the end of the week and then i am going to wait for the letter from UU and start the process of applying to getting it set aside
The defence and evidence i will be supplying to the courts is that I didnt get the oppertunity to defend myself against the ccj and i wasnt given the final oppertunity to pay and i never recieved the court papers even though UU had my new address (this i cant prove i have no bills or anything) i will be sending the tenancy agreement from my landlord stating the day i moved into the new property (15th October 2011) so i wouldnt of got the papers
What do you guys think? Do i stand a chance of having it removed or not?

Not the creditors responsibility to track you down. The papers can be served on the last known address.0

Yes, as you should have had a chance to at least dispute the amount and they should have sent it to the new address if the had it. If they are not opposing it it wont matter that you dont have proof, and besides the court can decide on balance of probabilities anyway.Still rolling rolling rolling......
