It is always a pleasure to be able to help anyone who has difficulty in undertanding to complexities of the legal system and to clear a little of the 'smoke screen' that is sometime created by a small minority of the legal profession.
In this particular case, the solicitors Practice has finally seen that their clients are in the right and they must account for the discrepancies they have created in acting as Professional Executors.
In many professions, problems can occur when their members are not kept up to date with the Law and particularly with the complexities of Trusts and Inheritrance Tax mitigation.
The combined information passed on by the members of this forum who have contributed here, has helped to bring about a satisfactory conclussion, or will have once the Solicitors Practice have made appropriate compensation.
On this last point, the OP should seek professional guidance to obtain an acceptable settlement.

One last update for all of you who helped. I spoke with HMRC this morning and their technical department agreed that as no Deed of release was created, just the letter from the solicitor appointing the sum of the trust to my Grandmother in 2007, that the loan still exists and must be paid from my Grandmother's estate to the trustees (my mother) before her estate is calculated. It is now below the IHT threshold and is tax free so they are closing the case!
The solicitor has saved themselves a rather large insurance claim and we no longer have to continue this fight thank heavens. It's been a very stressful 28 months but we did it with the help of many of you. Thank you very much!! :T0 -
Good to hear the result. I hope the solicitor will make some payment for all that you have had to put up with. If you don't need the money from them suggest they donate an agreed sum to charity instead.One last update for all of you who helped.
