Tenancy Agreements

Good Morning all,


Im after some advice, when I was with my ex, we had a joint tenancy on a house which we rented, when we split up on January 2nd 2014 there were £800 of arrears, I agreed to pay them and made an arrangement with the landlords to pay two instalments of £400 the first on 28th Jan and the second on 28th Feb 14, this was a verbal agreement with an employee that is no longer there. If I made these two payments then my name would be come of the tenancy. I did stick to this arrangement but the landlord refuses to take me off the tenancy because of the following reason.
"During the period since you left in January 2014 and until you made the final payment, more arrears had occurred at the property." now they are acknowledging that the arrears are from the ex not paying rent, yet say they can still deny me coming off the tenancy unless I clear all the arrears to date!!


Basically do I have a legal leg to stand on before I ask my solicitor to start dealing with them. (Which will cost me more money)


I have in black and white In form of a statement that there are no rents owing from my time living in the property.

    I'm afraid you are a joint tenant and as such liable for all debts (jointly with ex).

    The LL is obviously unwilling to rent the property soley to your ex as clearly (s)he is either unable or unwilling to pay the rent alone.

    LL would be mad to rely on your ex as sole tenant and lose the option of chasing you.

    What kind of tenancy do you have?

    Fixed Term? Dates?

    Periodic (monthly)? Give valid notice!

    Who did you make the verbal agreement with? Not the Landlord I guess, maybe with the letting agent who would say anything to you in order for you to pay up. You got nothing in writing and the chap now has left. I would think they would of denied it anyway. Now your name is still on the agreement and the account is in arrears again, doesn't matter when you left as you both are still jointly liable for the debt and the Landlord is well within their rights to go to the small claims court and obtain CCJ's against both of you.

    When will the current tenancy agreement expire?

    It was originally 6 month tenancy, then dropped onto month by month as it is today.


    I am going to try an obtain a copy of the contract, as it is with the ex who is not the most reasonable of person.


    The letting agency I am with actually own all there properties if that makes sense, the verbal agreement was with one of there employees.
