Hi Guys
Sorry to bother you all, I am sure you all ahve better things to do than answer my stupid newbie post!
I am attempting to claim £1400 (inc intrest) from NatWest bank. I never received a reply from them in the timescales in Martins guide, so I went through MCOL. 3 days after my MCOL request, an offer came through for £700. That was a few weeks ago. I have now had a mail, like many others on here, saying that their solicitors are going to defend, and the letter stated:
Attached to this are 11 pages of documents that I have tried to read through, but are confusing to me. I feel that I am out of my depth, and it could all go wrong.
My question is, do you think that the bank will still let me accept their offer now this has gone to court, and secondly, am I allowed to stop the court proceeding if they do.
I know it seems like I am being a bit of a wuss, but im the first to admit that I am now out of league!

A defence to this claim has been filed
The claim has been transfered to the court covering the area where the defendant lives.
Please red the accompanying documents carefully and note that the allocating questionairre should be returned to the Swansea County Court

Not sure if this will help much but I have had the same with a couple of my claims.
First a question. The accompanying paperwork.....what is it?
Depending on the answer to that, will depend on what you need to do next I think.
I have had 4 cases of mine passed to my local court, and similar paperwork, although not 11 pages worth. So far 2 have settled out of court for just about the whole amount, the other 2 are ongoing but looking good.
Give a bit more detail regarding the accompanying paperwork and people may be able to help further......good luck0 -
Sure, sorry, I should of included the details, I was a bit flustered when i wrote the mail (received it all this morning)
1 Says: Without Hearing it is ordered that 1. Judgement be set aside 2. transfer proceeding to claiments home court"
2 Says: It is ordered that: The filing of an allocation questionannaire be dispensed with in this case unless the district judge at the court of transfer ordered otherwise
3 Says. *my name* Claimant - NATWEST Defendant
Defence - This is filed and served without prejudice to the defendants case that the partiulars of claim do not disclose reasonalble grouns for brining a claim against the defencant to recover the bank charges. In the event that the claim is not poperly particularied then the defendant will apply to strike out the claim and summary for judgement.
this goes on fgor about 6 pages. I assume this is Natwests defence?
and the last few pages look like its the courts request for more information to natwest (when i claimed on MCOL)
is this any help, or if I scan the pages in, can someone just take a quick look for me?0
