TUPE & Redundancy

Hi all,

I've recently been told I am to be made redundant and I am just looking for a bit of advice on my length of service.

I started working for this company in 2010, and a year later we were TUPE'd over to an outsource company but all contracts remained the same. 2 years later I applied for and got a job back with the original company. Do I retain all of my years service, or just since I moved back over?

Any advice is hugely appreciated.

    It is the date that you started your new job with the old company that counts.

    The only reason continuous employment is protected when an employee is transferred to another company is by special legal protection under TUPE. This does not apply if you voluntarily leave one job to go to another - even if the new job is with your former employer.
