Damage to Credit File

Hello,


I was looking for opinion on 2 defaults that have been entered onto my credit file which is affecting my ability to get credit.


The first is by Vodafone. This occurred when, where I lived, the local mast became faulty and we lost coverage for almost a month.


I argued with Vodafone that they had broken my contract by not providing service. They disagreed. I stopped paying and they put a default on my credit file.


They then passed my debt onto various DCAs and nothing has happened.


So, in this case, I feel they should not be able to enter a default as the contract had been broken by them.


The second default has been added by Arrow Global Finance. They bought a credit debit I had with Capital 1. They tried to take me to court but because of the age of the debt, they didn't have the correct paperwork and they pulled out 2 days before the court date.


Shoosmiths were acting on behalf or Arrow and when I emailed them asking for the default to be removed they refused saying the case had been dropped based on a "commercial decision"


So, my credit file is wrecked.


I really feel that neither Vodafone or Arrow have the right to do this as they cannot stand up in court and prove either of their cases.


Is there anything I can do about this?


Any advice would be greatly appreciated!

    Arrow - No, they can default your account even if they can't get a CCJ. As long as its your account. When's the default date? Is it correct? They stay for 6 years.

    Vodafone - your only option is to complain and escalate to the Ombudsman if they refuse to remove it.

    A credit report is supposed to represent your true financial history, so if you did, in fact, default on those two agreements then it is an accurate representation and I don't understand why you don't think either company has the right to report this.

    With Vodafone, you should have continued to pay whilst you argued with them over the contractual issue.

    Which clause in the contract do you think they breached and what is the wording of it?
    What will your verse be?

    Mobile phone providers do not guarantee 100% service.
    "Facism arrives as your friend.     You should have kept paying your Vodafone account and followed their complaints process, they probably would have refunded you the line rental for the month.

    Lesson learned, just work now to not miss any payments or default on any other accounts.
