Tenant getting married -do I need to do anything

Hi all

I have a tenant who is getting married , the agreement is only in her name.

What do I need to do? Just issue a revised tenancy agreement?
Does he have to be on the new one or not ?
Do I need to change the secured deposit or do anything after she is married ?

Any advice appreciated

    If he's living there, he should be on the tenancy - and should be referenced-checked, as any other tenant.

    As the landlord you may have the right of 'droit de seignor'.

    No idea about the tenancy, it's not something that I as a LL have ever worried about, I just see it as an extra income into the household and your tenant is still legally obliged to look after the house and pay the rent

    The marriage doesn't change anything.

    You haven't said whether he already lives there, or is going to?

    Hi, he didn't live there in the beginning, but started to and will be now fully up to and after the wedding

    When I wanted my now husband to move in I asked my landlords first they simply come round with a new joint tenancy agreement and left everything else to us (ie council tax etc)

    Two aspects to this:

    1) the marriage. Send them a card congratulating them, and a bottle on/after the day.


    2) adding a name to the tenancy. Presumably you are happy for the partner to be added? Credit check etc in the usual way.

    a) issue a new tenancy in joint names. Either
    i) for a new fixed term of whatever length you all want (ie 6 months, 12 months, or perhaps 8 months & 3 days to tie in with the previous tenancy end date!)
    ii) or as a CPT if the current tenancy is periodic and that's what you all want (see Tenancies in Eng/Wales)

    b) Execute a Deed of Variation adding the additional tenant name to the existing tenancy. Get it witnessed in the normal way as per a Deed.

    OP seems satisfied that his tenant can be trusted to pay the rent on his own.
    As such would would be the point to credit check a joint-tenant?

    That been said, he might still want character references, especially depending on the terms of his insurance.

    Note also that in order to 'add' a joint-tenant to the existing tenancy (instead of creating a new one) the procedure is an assignment.
