Forgive me, but did the Govt. not make all this auto-renew stuff illegal with the onus being on the actual purchaser to select an 'auto-renew' option if available.

    No, but you're forgiven

As they have renewed the policy they will want the money for the premium otherwise they will eventually cancel the policy and would pursue the OP for a premium from renewal until the date cancelled.

So why hasn't the OP received both a new certificate and, as per the direct debit guarantee, a schedule of payments?

They almost certainly sent this out as it's an automated system, I assume the OP just binned it without opening it or ignored it as he'd sent the email or the royal mail did not deliver it.

The OP does not mention whether or not they received them

Thank you so much for the feedback; lots of usefulness! :A

Re some of your q's that popped up:
I didn't receive any paperwork from KF other than a couple of correspondences I mention (plus a couple of emails); I don't throw any mail addressed to me personally without opening it first and can confirm that I have never received any policy docs or payments schedule mentioned above. The first I knew that the policy had been renewed was the DD from my bank account a couple of weeks ago, although they say the policy was renewed at renewal date of beginning January.

Re sending them a copy of my new policy; I don't feel obligated to do this as it seemed as if they were too keen to get hold of this info and can only assume it's because they want to see what their competitor has quoted. This is just snooping in my opinion? I have informed them that I have a new policy and if they are that committed to lawfulness they can check on the register and/or report it to the police who can confirm it? As far as I am concerned any obligation to them ended when the policy ran out and after I confirmed that I would not be renewing with them... :(

They don't need to see your new policy to see what you've been charged - they'll be well aware of what rates are being applied and where.

You're quite right that they have no legal entitlement to see the new certificate but, as dacouch has said, supplying it will help to sort this out in the least painful way possible for you.

As the situation stands they claim they didn't receive your cancellation. That may, or may not, be true - email systems do fail at times, just as stuff does go genuinely missing in the post.

So, from their stated position, they've renewed perfectly legitimately as they were required to do by your contract with them. Taking the flip side of that for a moment - if you had a policy with auto renewal and they didn't renew for some reason you'd be rightfully entitled to be pretty peed off when you got pulled for no insurance!

Sending them a copy of the email shows absolutely nothing because, as far as they know, you could have written that yesterday, at the point where you decided you didn't want the policy any more because the car had just catastrophically failed its MOT.

On the other hand, showing that you had, indeed, taken out a policy elsewhere at the same time is strong support for your claim to have cancelled - or at very least that you intended to.

Also there's been a policy in force with them that, in the absence of your new policy as evidence of cover, would leave them liable for the fatal accident you had last week but haven't yet notified them of.

You can, if you wish, tell them to see you in court. But that will mean defending yourself in court and, in the meantime, having your insurance record marked as having a policy cancelled for non-payment and your credit score marked with late / non-payment.

While both of those markers could be corrected if (and there's no guarantee) you won in court, it's a slow process and likely to cause you a world of grief in the meantime.

If you can avoid all that just by sending them a copy of something they've asked for (even though they're not entitled) then why on earth wouldn't you?

eta: as for the new certificate, it's entirely possible that it was made available online for download, which an increasing number of insurers are doing to save costs. If that's the case then, in lieu of the certificate itself, the RTA allows a simple written statement instead to the effect that the policy has ceased to have effect (ie: in tis case that you didn't want it renewed and they have no liability under it).

They have offered to refund you if you show them proof that you had indeed taken out another policy elsewhere.

Just comply and short cut the aggro. A copy of your cert should satisfy them (and satisfy you they don't want to know how much you paid - no premium will be shown on the cert)

The rest of the aggro you are getting is down to their "auto" debt chasing which looks to be running alongside the tailored individual solution you have been given.

They only want to see the Certificate of Insurance, this document does not say what the premium is!

They want to see it to so they know they were at not of risk of paying a claim
  • Thanking you again, some good pointers! Will post an update as and when...
