Estate agents!!! Pain in the ***

So we've been waiting 2 weeks for draft contracts to be sent to our solicitor so we can start searches and get everything moving... Got a letter in the post today from a random solicitor firm saying they have our contract and we need to send back the forms they sent....

Can't ring to find out what's going on.. But on digging seems this is the solicitor the estate agent recommends to use! And by the looks of it it despite from the very start me saying I have a solicitor ready to go they've provided these details to the vendor! Someone is getting an !!! kicking in Monday!

    Did you give the EA a letter informing them of your solicitor's details?

    If you didn't provide them with alternate details then this is what they will do. We had the same thing only because they talk to you on the phone and word things in such a way that it may seem that you agree to using their recommended conveyancer.
    It doesn't matter anyway in your case. Just provide them with the details of your chosen solicitor. No harm done.

    I realise no harm done. It's just extremely annoying as I've been chasing for the stuff to get sent for 2 weeks. And have been told it's been sent 3 times now.

    Formal complaint to both the EA and their tame solicitor for acting without instructions (I assume you've had no client care letter, scale of charges, or anything else from the tame solicitor for you to sign and return?).

    Refuse to pay any bill the tame solicitor might want to send you.

    Make sure your own solicitor writes to the seller's solicitor to confirm they act, and to the tame solicitor to retrieve your documents if the seller's solicitors won't resend them.

    Did the EA send you the usual 'memorandum of sale' specifying the vendor, your solicitor, the vendor and the vendor's solicitor? Every time I've bought in recent years, that's been sent by the EA to all 4 parties, as in effect, an instruction to the solicitors to start action. Which, of course they won't do until you too instruct your solictor by signing their contractual terms and bunging them an initial payment.

    So nothing lost except a bit of time... and the agent's reputation...

    Alex they did. It was wrong I rang straight away. It was corrected and a correct one sent out!
