  • Hello again, so I recently got another letter from BW Legal and a call saying that I haven't contacted them even though I've sent them an e-mail with all the right information, reference numbers etc. and I got a automatic reply confirming that they have received my e-mails. I have also contacted CSA to see if the information that BW legal are giving are correct and that's some of the points that they have given me:

    · Balance plus charge – our member may be entitled to add certain charges to the account, based on the terms and conditions of the parking conditions/warning.
    · 10 day time frame – as the balance has been outstanding for some time, a company would be entitled to set a specific date for the balance to be paid. It was my understanding at this point they would initiate legal proceedings. BW Legal has provided opportunity to dispute the account by contacting them directly, this may be beneficial so that they are aware.
    · CCJ and cost – if no payment was received, BW Legal could make the option to initiate legal proceedings. If this was granted, the charges for this could be include in the balance

    I'm also attaching the pictures of the letter that they have sent out

    Please advice on what to do because I really don't know. Also, is there really no company that would deal with it so they can just leave me alone and so I don't have to go to court? :(

    it would cost you a fortune to be represented in court , so unless a lay person does it for you pro bono than I would say no, there is no company that could make money doing it for you, plus you would not afford it , paying up would be cheaper

    put BW LEGAL into the forum search box and you will see a dozen or so recent posts about the same thing, VCS and BW LEGAL , all debt collector letters sent to coerce you into paying

    only VCS can try a court case, or a solicitors acting on their behalf
  • I didn't mean a solicitor, I meant like a third party company who would look into it and decide whether they're right or they're wrong.

    Should I actually call bwlegal and tell them that I don't agree with the charge or just leave it or I don't know?

    and also does bwlegal actually take anyone to court for this? and if so do I have a chance of winning if I don't have anyone representing me in court?

    Should I just pay it or leave it?

    I already told you who takes people to court, it would be the creditor, in this case VCS

    I gave you all the options, you can cherry pick what you like from the reply

    doesnt matter if you meant a solicitor or a third party, its small claims court so unless you get a lay rep to help you then you must sort it out yourself

    I already told you that there is no "3rd party company" who do this work, which is why Barry Beavis had to sort it out pro bono, or via crowd funding

    if you employed somebody, it would cost you a lot more than paying the charge, plus you can only claim back up to £90 if you win

    doesnt matter what you do or who you ring up, the only thing they want from you is the outstanding monies they say are owed, anything else is futile, you might as well try to fight the borg, they want to assimilate you , not negotiate

    BW LEGAL is just a new kid on the block in a long line of debt collectors, that have no powers, so as I said earlier, and repeat, only VCS or their legally appointed agents can take you to court, so its either VCS or any solicitor they may use (like Gladstones or Wright Hassell etc)

    I suppose that it may well be that BW LEGAL are a solicitor as well and may issue court proceedings on behalf of VCS, but they dont appear to have done so yet, but as I told you, they are new kids on the block !! time will tell (hoohoo already told you this in post #21)

    the situation is no different now than it was 13 months ago in my first reply in post #4
