Pothole Claim Rejected - Suggestions/Advice?
Comments

If I reported every pothole on the roads round here I would never get anywhere. There are hundreds of the bloody things.
The side roads and main roads are bad enough, but the ring road is potentially fatal, to date I have not seen any repairs done in our area, even after reporting them. Its an endless battle.
The problem is, if they do not get reported, you cannot make a claim as the council will say it must have only just appeared.:A:dance:1+1+1=1:dance::A

You are right to report them as you see them.
TBH in my years of driving I have never seen a pothole on a motorway.
That said you shouldn't need to swerve out of the way of a pothole as they are stationary and it is the car that is moving.
Try driving down the M2, you'll see plenty! Not the best welcome to visitors coming into the country.Remember the saying: if it looks too good to be true it almost certainly is.0 -
Can you give an example of where these temporary repairs only last 3 weeks (as a none civil engineer to none civil engineer) .
Well I can but how will you know where I am talking about? The road which runs along the end of the street I live in has a cluster of pot holes which have been filled in at a frequency of every 10 to 14 days.I stand by they won't win a claim in this instance.
So your'e a county court judge then?PLEASE NOTEMy advice should be used as guidance only. You should always obtain face to face professional advice before taking any action.0 -

I can know from google or looking at the report potholes site to see if they have already been reported.
We don't need to be a county court judge, the OP is not going to be succesful in a claim this time around, the council have already told him to do one :eek:0 -

I don't see the need for you to carry out an investigation into my claim that I say a temporary repair can last a lot less than 3 weeks. We don't need to be a county court judge, the OP is not going to be succesful in a claim this time around, the council have already told him to do one
Just because the council have rejected the OP's claim dosn't mean that he has no legal avenue to take. I damaged a tyre on a then new car on an exposed iron surround of a man hole cover a few years ago which the council quickly rectified after I complained, and they too rejected my claim. They soon changed their position when they received my court claim.PLEASE NOTEMy advice should be used as guidance only. Because tbh I think the repairs last longer than 3 weeks and your statement on short duration is close to BS.
Ironworks are not potholes, and every case is individual, 8/9 pothole claims are not upheld, as said once again, I fear the OP will be one of the 8 out of 9.0 -

Steady... you'll be calling me a liar next. Perhaps you work for a council and this is a sore subject for you? :cool:Ironworks are not potholes, and every case is individual, 8/9 pothole claims are not upheld, as said once again, I fear the OP will be one of the 8 out of 9.
Yep, deffo speaking like a council employee.PLEASE NOTEMy advice should be used as guidance only. You should always obtain face to face professional advice before taking any action.0 -

Strange that? How many occupations have I had ? Civil engineer, Council employee, O2 employee to name 3.
I wouldn't know if you are a liar or not, however common logic dictates that just because you had a succesful claim that the OP will too.0 -

Hmm, I think I know what you mean but lets make one thing clear, I didn't say the OP's claim would be successful (unlike yourself who categorically said it wouldn't be), I said from the OP's account, it was worth pursuing. Unless the council changes it's position, It would be for a judge to decide the outcome.
What I would suggest the OP does is get face to face professional advice from a solicitor who specialises in damage claims. Most will give a free initial consultation.PLEASE NOTEMy advice should be used as guidance only. You should always obtain face to face professional advice before taking any action.0
