This is an airport byelaw offence not a normal parking PCN. byelaw offences don't fall under the normal private parking practices.
A fixed penalty notice is correct for a byelaw offence. Failure to pay a fixed penalty for a byelaw offence will almost certainly end in a session at the magistrates court.
In this case it almost certainly will not. UKPPO is in fact a sole trader who has no power to bring a prosecution, and nor does he want to given that there's nothing in it for him. He hasn't even entered into a contract since he never reveals his true identity. A mere trading name can't enter into a contract.
These notices issued at Newcastle Airport are the worst case we've yet seen of speculative invoices pretending to invoke byelaws and threatening prosecution, far worse than anything seen from rail operators. What they are doing is almost certainly illegal.Je suis Charlie.0 -
So I replied to give them two options: either drop the charge as they have no power to issue let alone enforce it, or direct us to POPLA. Two days later and still no reply. Can I assume that they have backed off?0

No chance. There's no PPC that efficient! And very few back off while there's the remotest scent of wonga!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
