landlord not registered (Scotland)

Hi hope this is right place to ask, but have just found out this evening that our landlord is not registered. Am now aware that should probably have looked into this previously but as we went through a well kknown site had assumed would have been pre-requisite. We are actually in the lucky position to finally be able to buy and hope to purchase a house soon. What problems could landlord not being registered cause when we want to move out when it comes to assessing proportion of the deposit back?

This is first flat have been in since we were in student halls so no prior experience!

Are you saying that your LL is not registered with the local council? That's a criminal offence and he should be reported to the council so that they can send him a letter or do SFA. However, his lack of registration with the council has nothing to do with your deposit. Did your LL protect your deposit?
  • Hi thanks for your help no- I had a look on the website and it didn't come up. Could I be in trouble for renting from them? How do I check if deposit is protected. Feeling very stupid as never checked this before. Been here for 5 years so will this have an affect on it?

If your LL isn't registered he's committing a criminal offence but you're not going to get into trouble for it.

See Shelter Scotland's guide to deposits for more information.

If your deposit isn't registered that's far more a problem for your LL than it is for you. :)

I reported our landlord not being registered (Renfrewshire) and nothing was done about it. Local council said they received my message and would investigate. He continues to let the property and still doesn't show up on the registry.

Aberdeen City Council were equally useless. I'm thinking about escalating it to Margaret Burgess at the Scottish Parliament and asking what the point of LL registration is if none of the unregistered LL are ever prosecuted.
