Redundancy leave entitlement

I don't have a PILON clause in my contract. I maybe made redundant at the end of March. My notice period is 12 weeks.


If I take PILON, should I be paid for leave accrued up to end of March or to the end of my notice period?


If I am paid garden leave instead of notice, will any leave I have accrued but not taken by the end of March be paid or assumed to be taken during the garden leave? I assume any leave accrued during my garden leave notice period will be deemed to have been taken in that period.

At the date of termination leave accrued to that point and not taken need to be paid.

if there is outstanding notice which will result in PILON a company can assume that any holiday accrued during that period could have been taken so does not need to be additional to the compensation payment, although some companies do pay it.

Your workplaces garden leave policy is not known to us.

Check your contract some have special conditions for holiday during notice and redundancy which can override the normal statutory notice for holidays requirements.
