Renting fees with useless Agency!

My mate is renewing her fixing contract with the agency that she rents from for another 12 months. Problem is they are so useless and never get back to her to even sign the contract and never call her back when she calls them and they are always 'busy at the moment'!

At the end of March 2015 she wants to stay in the renting house but they want £80 in renewal fees! She likes the place but the agency can't and don't even do anything and she is all the time running after them! She don't even know if her deposit is even protected cos she never got anything back from the agency othen then where the money is going into. Don't u get a ID or email or something?

She is scared if she says something they will give her a S21! :/

    Your friend's contract is with the LL not the LA. If repairs are not being done (She has written, pen and paper, to the address for the serving of notices in her TA, to report the repairs, hadn't she?) then your friend can ask the LA for the LL's contact details which the LA must supply within 21 days. Then your friend can report the repairs to the organ grinder rather than the monkey.

    Why is your friend so keen to spend £80 (which is actually not bad compared with some renewal fees quoted on this forum) to sign another fixed term. If she does nothing the tenancy will automatically become periodic when the current fixed term ends.

    As for the deposit, yes your friend should have received the Prescribed Information when the deposit was registered with one of the schemes. Your friend can check with all 3 schemes to see if her deposit has been registered anywhere. If it transpires that her deposit hadn't been registered anywhere then this is much more of a problem for the LL than your friend. So much so that if the deposit hasn't been registered your friend is better off not mentioning it to either the LL or the LA until the end of her tenancy. It's a nice ace to have up her sleeve.

    The agent is employed by the LL. It's his choice.

    Tenant's contract is with LL, not agent.

    I did say to her that if it ain't registered to keep that as an ace card to the end of the tenancy. What will happen in this case if LL ain't put her deposit in protection?

    Looked on her tenancy agreement and it don't have the LL's address just the LA's address. She gave in the deposit money to the LA and they did give her a receipt but she is worried and getting me worried for her now.

    Unless the LA is the LL

    If her deposit isn't in a protection scheme she can sue them for 3x the deposit back. It would be wise to wait until she leaves though.
