Non-performing seller

Hi,
I won a pair of designer for a ridiculously low price.
They are £249 and I won them for £26 plus postage.
I had a feeling the seller would have been peed off with such a low-selling price.
Yo and behold, today I got a message from him saying he got the size wrong and they aren't a size 39 but in fact a size 36 so he'll refund my money.
My best friend is a size 36 so I sent back a message telling him so and asking him to still send them to me.
He then sent me a long-winded message saying they should never have been put up for sale (they where there for 10 days) and his wife has offered them to her cousin so he can't sell them to me.
I suspect he's pulling out of the sale because he wanted more money.
I have tried to navigate Ebay to report him as a non-performing seller but it's like the crystal maze on there.
Can anyone help me on how to do so?
