It appears you may not have been misled after all.
Then get the VIC done. It'll cost you £41, but your biggest problem is getting it to the test centre without insurance. If it passes the VIC then return the car to the dealer for a refund. If it fails the VIC then you have a strong case to reject the vehicle, in Sale of Goods Act terms, as not conforming to contract.
Be careful of going down the chargeback route.
Your bank will insist you return the car and will then refund your money.
However, the dealer can appeal that and if they show good enough evidence, maybe that HPI letter will be good enough, then the bank will re-debit your account and pass the funds back to the dealer.
You are then left without the money or the car... be very careful.
I called up the dealer and told him that he'll have to refund back the amount if it fails VIC, and he agreed. Also, I asked him to accompany us for the VIC test and he said that he'll come.
I told the dealer that I would leave the car in his garage as I dont have insurance to keep it in front of my house. I will return back the keys and documents once he gives my money back. Do you this is a good idea?0 -
Surely the only reason it would fail a VIC is if it is a wringer? a VIC is purely to make sure it's the same car that is going back on the road. All it checks is the identity of the car. If it is a wringer then surely the place selling the car wouldn't have a leg to stand on anyway?0

So if it passes the VIC are you still giving the car back? I really don't see what the problem is here apart from having to get the VIC done, you bought a car knowing it was Cat C. As far as I know all Cat C have to be VIC'd before a new log book can be issued.0 -

why has the check not been performed before? , why now ?
it looks like the dealer bought a right off and repaired it
even if the old owner had have crashed it , had it repaired he would have been told to have it checked before going on the road and his old V5 was null and void0 -

I don't think this is the case - as far as I am aware the VIC marker only flags up at change of owner or when the car needs taxing again. The old owner could still drive the car as long as it was safe to do so - the VIC has nothing to do with vehicle safety.0 -

Really, you bought it knowing it was a cat C write off.
That changes everything.
To be honest if you have just had your insurance cancelled you now have a really big problem as you have to declare that and any premium has just sky rocketed on any car you buy now, most wont even quote you for six years .
Buying any category of write off is the worst type of money saving idea going.I do Contracts, all day every day.0
