Consumer guy, there is no facility to PM you but wanted to thank you for advising me to put in a paypal claim for my daughter's faulty phone. She just had a full refund today after sending the phone back. So, many thanks. She only lost £9 postage and £15 import tax instead of an extra £109. I know i'm late to the party but contracts dont require money to exchange hands in order to have a binding contract in place.
But, just to throw a spanner in the works....some people pay for their TCB accounts in order to receive a preferential cashback rate. So they undoubtedly do have a contract with TCB which will place TCB under a greater duty of care.
