rejected hardship claim help needed

Options
Hello everyone,

Firstly a bit about me my oh left his job after many years and we moved to be close to a sick family member. During this time we hit rock bottom had to claim benefits to tie us over.

My bank have been charging me for being over planned overdraft swallowing up my child benefit. i was over planned over draft by about 200 i fell behind on all bills credit cars ect. i even had phone cut off so it's not been easy .

Now i put in a claim explaining this for my 6 year total charges was around 680 .

I had 100 paid in to my account this week and now i have a letter saying, that my claim is rejected but they will pay 100 goodwill which will leave me still overdrawn and also my credit car will have around the same paid also leaving me over drawn . Could i call to pay off the remaining over due amounts on the accounts.

Now after reading instructions it says to call back and ask for more how much should i ask for?given the situation i am behind on so much.

Sorry for my terrible writing i was in a rush to get this out there. Any help given will be much appreciated.

Take care

So, key thing is that you requested they refund 6 years worth of charges.

So, they have not bought your financial hardship position. Although £100 is not a bad result.

You need to focus on your financial hardship. The bills you in arrears with. How it is reducing your livings standards below the breadline. As long as you have no luxury spending on your statements (such as sky tv or mobile phones, electronic items purchasing etc) and can make a good argument, then they normally agree. So, clearly your view and their view differ and you need to work out what it is.

Firstly thanks for your speedy response .

Yes 6 years worth of charges as i read that's how far you can go back.

Yes i did not mean to come across ungrateful i was very excited when i see the dent in to my over overdraft it was nice:)

There has been no spending at all in past couple of months, as soon as we moved we got rid of cable tv mobile got cut off so that was not paid no meals out pretty much just scraped by.

literally the spending was gas, electric, bank fees and charges . So yes i do think i have a good case its clear to see in my bank that i am skint and the charges genuinely have spiraled and got me deeper if my account was not over due to charges my child benefit would have paid other bills.

So would you recommend phoning them?

No. That is not correct. Each financial hardship case is considered on its own merits. Most only get back 6-12 months work on successful cases. Some have, however, gone back further than 6 years. Although those are rare.

Some cases get no refund but get charges suspended for the next 6-12 months. The bank has a lot of options available to it. Refund is not the only one.

The bank would have checked your statements and if they saw cable tv and mobile phone spending (above a low level) then they would think that you are not in proper hardship. After that point, they may consider it and that is possibly why a goodwill gesture was given.
So would you recommend phoning them?

You have nothing to lose. You just need to paint a picture of desperation and get the person you speak to see that.

    Thanks again,
very informative i did not know that about claim timings doh.
I will call them and explain my bank has only incurred charges when i have been in hardship so i think as long as i am truthful and assertive i stand a chance.
I will update on the bank charge success or rejection page when i have spoke to them fingers crossed .

You have been very helpful take care all the best
