Rental Contract Help Please

just looking for some advice please, Ive just been re reading through the contract our tenants signed, as I wanted to check some points
and it states (and is signed by them)
that for the last two months a for sale or to rent board can be placed, and reasonable access for agent, to photograph and show the home mut be given,
obviously I would greatly abide by the reasonable etc,
so we could put the home up for sale at the two months before term ends?
also it would be the same letting agent that would be advertising to sell, so they would definatly work with the tenants re viewings ( again working with them so they didnt disrupt their lives)
would that be reasonable,
also I know alot of the time, a rental reduction can be offered as an apology for this?

This maybe the standard terms the letting agents put in the tenancy agreement BUT this is NOT THE LAW.
Once you have a tenant they may refuse all viewings as it is there HOME from day one of the contract until the end of the contract.
Now if you offer a reduction in rent and CONTROL the letting/estate agents so they do viewings to suit the tenant times when tenant is in and NOT 9-5 because that suits the estate agents.

You can put anything you like in the contract, it doesn't make it legal.
Unreasonable terms can't be enforced. You can put the house up for sale but the tenants right to quiet enjoyment trumps your rights to show people around.0 -

OP, if you want to do viewings in the last two months of the tenancy best to try and arrange an amicable agreement with the tenant.
As you can tell there is all sorts of disagreement about the law on this, however from a landlord's perspective if the tenant digs their heels in and refuses any viewings your options legally are very limited so best to come to a compromise.
Definitely would advise you not to ever enter the tenants home without permission.0 -

It's a reasonable term and is not 'trumped' by anything.
OP - you appear a reasonable landlord. Speak to the tenants. You need to find out anyway if they plan to leave at the end of the tenancy - no point advertising for sale if they are going to be there for months while you evict!
Assuming they are plnning to leave (ideally have somewhere lined up, then discuss how you can minimise the disruption to them. Suggest that they suggest a couple of days/times they'd prefer.
ask if they prefer to be there, or not be there, and agree to whichever.
and yes, offer a discount on the rent, or one-off payment if it seems appropriate.
It is all down to relationship managing.

Take into account whether your tenants can easily find another property, make sure your S21 will be perfectly correct otherwise a possession order will be refused, that you protected the deposit (same), then you will need to get bailiffs or sheriffs in, this can take time. Just because you give them notice calculated to end at the end of their fixed term, doesn't mean to say the tenants will move out.
Also, having tenants in situ while doing viewings could lessen the appeal of the property and reduce the price. Expect more LL's/developers wanting to offer bottom dollar!0 -
