deposit not covered by scheme at beginning of tenancy...

    Yes i did pay my deposit to the letting agency... i believe they hold the deposit as they initially stated that they woukd return it to me...

    i think maybe seeking advice from a legal specialist may be in order :)

    and yet post 1:
    On looking at my tenancy deposit summary it says my tenancy started on 12/10/12 but the deposit wasnt registered until 16/04/2014 with TDS...
    so deposit is in a scheme now.

    Yes the deposit is in a scheme now but wasnt protected from october 2012 until april 2014....

    i am not sure what what point you are trying to make?

    Your deposit is now protected, so any deductions will follow the scheme rules.

    It appears that amongst other things, the LL wants to deduct from the deposit for damage to furniture/furnishing and OP is trying to counter attack by scaring the LL with the deposit scheme rule - thus having his deposit returned hurriedly and in full. Hence my earlier suggestion:-


    However, company B has to prove the damage and proportional deductions above wear and tear for the 2.5 year occupancy - which they presumably cannot, so arguing your case on these points may be a better plan than leverage or counter nonsense.

    Taking the deductions out of the equation completely and the current dispute..

    i still have the ability to take the landlord to small claims court to seek compensation regardless of the deductions for the 2 and a half years i wasnt covered for....

    they may take deductions out of the compensation rewarded if the deductions are deemed still standing

    Did you suffer any financial loss by the deposit being unprotected? I doubt it, given that now it is protected.


    So basically this is just to put pressure on the landlord to release all your deposit, a reflection on the compensation culture we live in.

    You need to establish who you need to sue, company A or company B and to find out if you would be liable for their court costs if you lose.
