Managed to speak with our solicitor and there is no written mentioning of 'right of way' on our deed...
I would still check the neighbour's Title. If his Title provides a ROW a nice expensive legal battle could ensue.....
  • Well...the neighbours Title Plan could be checked usefully - ie to see if there is any mention there of having to pay towards maintenance.

But ..we come back to the fact that if neither Title mentions neighbour having to pay for maintenance they don't.

If neighbour HAS to have ROW not to be trapped within their own home then they do have it (ie if they've had it for over 20 years).

I will check next doors Land Registry title. Is it the Title Register or Title Plan I need?

We would not prevent access. Our thoughts are that we would provide 1 key to ensure 'access', but then charge for additional keys that would go towards to cost of repairs.
