Will my appeal succeed?

Hi all,
I have received a parking 'invoice' for parking in a FREE store car park whilst the shop was closed. The most annoying thing about this is that they have a barrier, but they never close it!
I parked there at night (21:00) for 2 hours, the sign read that parking was only allowed when shopping in the store. I have obviously breached this.
However, the invoice is £85 early pay, £100 late pay (oh, and the b**tards charge £4.50 for payment) - I believe this be unfair as if I recall correctly they cannot really take me to court as they have suffered no losses as a result of me parking there, and therefore the invoice will lapse?
They have also got my registration wrong on the ticket and have missed the last letter of my plate off. Does this therefore render it invalid? They do have photographic evidence of the rear end of my car.
The invoice is from premier parking logistics.
Does anyone have any advice on how to proceed? I'm a bit of a parking ticket newbie!
All help appreciated.
Thanks
Ps The appeals line is amusing, it says, if I wish to appeal I must 'supply evidence as to why I WAS in violation of the parking terms and conditions'

They can take you to court and they have/will incur costs, but not nearly as much as they claim.
Read the Newbies guidance and proceed from there. You never know how far you can go until you go too far.0 -
As above plenty of help in the newbies thread, but in brief:
1: read the newbies thread
2: challenge the ticket to the parking company - and if appropriate complain to the car park owner, you could argue that as the barrier was up, you reasonably assumed that you had an invitation to park on that land - as it is a car park, and you expect the land owner/car park owner to take steps to cancel the ticket issued by their agents, also tell them that should they fail to cancel then you may be holding them liable for any costs you run up as a result of their agents unreasonable actions.
Also tell the parking company the same - you may charge them for your costs
3: expect the challenge to the parking company to fail
4: take it to POPLA
5: If its POPLA then expect to win, if IAS expect to loose.
6: If IAS and you lose then you are under no obligation to pay, likewise with POLA.
if however its IAS then complain to the DVLA.From the Plain Language Commission:

Well, besides reading the Newbies thread - in terms of enlightening yourself - there is probably little point in doing very much as Premier Parking Logisitics are not members of either of the ATA's (BPA or IPC AOS's).
On that basis they cannot obtain keeper details and cannot therefore pursue the so-called PCN - so do nothing and do not contact them in any respect. Their website is a joke.
PPL is just the latest vehicle (pardon the pun) of a well-known Brummie ex-clamper (Walton Wilkins) of whom there are plenty of tales - Google is your friend. My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com0 -
Thanks.
So basically if I ignore the ticket, then I will be OK and can't face any further action due to the company who issued it not being able to get my details?
Or do I need to send an appeal?0 -

No, absolutely do NOT send an appeal or contact Mr. Wilkins in any way. He has no means of finding out who you are, don't give the game away by contacting him!
Also, please don't make another 20 posts seeking reassurance. I don't know if it's a Birmingham thing or what but it seems that every time Wilkins' outfit gets mentioned here the OP doesn't quite believe us and goes on and on inventing various ludicrous scenarios as to how they might get his name and address.
Yet not one of them has ever reported back that he ever heard another damn thing about it.Je suis Charlie.0 -
In which case...
I'll ignore it.
I shouldn't hear anything more from them. Donkeys.
Shame as it used to be a good free car park but they've obviously recently employed these scum!0 -
If it's just a windscreen ticket, then wait to see if you get anything in the post.if the company is not in an ATA, and you get something such as an NTK, then it's time to complain, and take action.
To see how much of a bad joke this company is take a look at their website. From the Plain Language Commission:

You could continue to treat it as a good free car park and just ignore all the tickets. Generally we would say that if the landowner doesn't want you to park there then don't, but when it comes to bottom-feeding scum like Wilkins it wouldn't surprise me if in some locations the landowner doesn't even know he's doing the ticketing.Je suis Charlie.0 -

Probably and will prove almost impossible for them to send you any letters.PLEASE NOTEMy advice should be used as guidance only. You should always obtain face to face professional advice before taking any action.0 -
Okay.
So there's no way they will get in contact with me?
Just want to be certain before I ignore it and put it to the back of my mind
They do have my reg from photos.0
