Unable to move into our new Bellway House - Advise please

Hi everyone
We recently bought a new build property from Bellway . We were given 4 weeks to complete the whole process of buying and we were in return given a discount of 12000 towards purchase of house . We also paid for special tiles for bathrooms + kitchen .
From our side we completed everything in 4 weeks and the keys were handed to us on 27 /7 but the house still does not have floor tiles in bathrooms + kitchen . This means we cannot move into our new house . So at the moment we are paying expenses for 2 houses. Our phone+ internet is going to be disconnected tomorrow from present property .
The bellway people are saying that hopefully they will have it ready by end of next week .
We are wondering if MSEs can comment on the following for us -
1) Has anyone been in similar situation and what did they do
2) Can we ask Bellway for compensation as we are unable to move on time ( though we have finished all formalities from our side)
3) Can we ask them to return our money and then get the tiles fitted on our own
Do we have any legal rights on above

I'm not sure if an impartial judge would agree that not having your "special tiles" means you can't move into the new house.
Therefore option 2 is not really valid --- as I see it you could still move if you wanted and just put up with having no tiles in kitchen/bathroom.
You might be able to do option (3). But did Bellway promise that the "special tiles" would be ready by 27/7?

Whilst it is obviously inconvenient for you and naughty of Bellway, you can live in a house without floor tiles. Many people do worse!
I should think you could aks for the money back with a little bit on top but claiming that you can't live in the property is taking it a bit too far.Everything that is supposed to be in heaven is already here on earth.

I dont understand why you cant move in. its not like the lack of tiles makes the place uninhabitable.
I think you are wasting a lot of money on 2 properties here, adn I really cant understand why you would want to do this for the sake of some tiles:beer: Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.

I'm not sure that many people from Gloucester or Tewksbury would agree with your point of view regarding the tiles, at this moment0

You are lucky we haven't got any floors in ours!! our move date has been changed aswell so we may end up having to move in without any and have it done then which will be a nightmare. I think unless the people have stated that they would have it done by a definate date then you may be able to ask for compensation due to inconvienience as it's a real pain once everything is in!0

are we talking about ceramic floor tiles?they are usally put in at first fix as the bath and loo etc need to fitted after the floors been laid why werent your? did they not have your choice?floor tiles woud not stop the house getting cml so house is complete the floor tiles would be optional extrasmy bark is worse than my bite!!!!!!!!0

Sorry, I know its not what you wanted to hear, but the reality is that you are being a little awkward, and the only one losing out is you.
You need to check the paperwork you signed regarding the extras and see what it says about when they will be supplied etc. I imagine that there will be some clause about them atempting, but not commiting to have them in by legal completion.
Option 3 sounds reasonable though0 -

Just to clarfy -We are talkng about ceramc tiles to kitchen and 3 bathrooms + Bellway were also going to do wall to wall tiles for each.
After paying so much we were expecting to move into the house when fully done and did not want the hassle of stayin n the house and then having everything done .
I think I will need to look into the files again and see what the terms say
Any more advice ??

You shouldn't have completed before they had fulfilled the contract. Now you have no leg to stand on and will have to chase them up for progress, I am afraid. Forget about getting money back. Perhaps you can ask for carpets fitted in the bedrooms though. Speak to the site manager rather than the sales people.0
