How do you know they havent been grafted? I know we did some grafting and after a while it'd be near impossible to spot where it was grafted.
Fair comment as I hadn't told you what I ordered and not everything needs grafting.
I ordered 2 named varieties of walnut and a cherry 'Penny'.
So , when you click cherries you are firstly required to choose a form or rootstock ; I chose 'colt' which is a semi vigorous rootstock so , by definition, would need to have the Penny scion grafted to it.
On researching the walnut trees it seems it is almost impossible to root cuttings and that grafting is standard practice in the industry ( grafting doesn't just allow a clone of the variety wanted but also helps control the vigour , or lack of it , in the plant)
I have also been to my local nursery who had the 2 same varieties in stock - both were twice the size and the graft was immediately obvious.0 -
It makes no difference what they say, they can not supersede the OP's consumer rights.
The OP asked if bare root trees would be considered persihables and could not be returned.
If he had read the Terms and Conditions it would have answered his question

They may get back to me on Monday saying "keep the trees, here's your money back(or - here's postage)" and everything would be sweet but seeing as they have ignored the Monday email and have ,so far, ignored the email I sent on thursday it seems most likely I will not hear back and hoping I will go away.
Their t&c's require the buyer to pay for return and seeing as trees are not small and require special packing ( they came in straw and large paper sacks which I no longer have) it is quite onerous especially as it is their fault.
I guess my question in the absence of satisfaction is- what do I do next and how long do I wait before I do it?0 -

When the trees arrived none were grafted and so can't be what I ordered.
However, if the goods do not conform to contract you should notify the seller that you are rejecting the trees, as allowed for under Sale of Goods Act section 35.

In hindsight perhaps I shouldn't have thrown packaging away ; but it's not as daft as it sounds. The trees weren't unpacked straight away as I wasn't ready to plant them so were left outside and got wet. (all reasonable as damp cold is just right for temporary storage before planting). Didn't really want wet straw and wet paper sacking lying around in the garden.
As to rejecting the trees - Have I not done that in post 4 of this thread or is there more exact wording I need to use? What is a reasonable length of time to allow them to respond before I write again?
