HELP!!! item not recieved?

hi,everyone
i have a problem with an overseas ebayer.(usa)
and need your help!!!!
here is the story......
i purchased a wifi-sd memory card from them on the 17th march and paid extra for insurance.
i paid via paypal on the 18thmarch.
they mail me to say it is out of stock,and would be sent out as soon as they came back in,so i thought thats fine.
i recieved an email saying it has been dispatched on the 25thmarch.
on there delivery faq it says 7 to 10 business days for delivery to the uk.
various emails to the seller asking for them to find out where the package is or if i can have the tracking number draw a blank.
after a 4 week wait i filed an item not recieved with ebay/paypal.
they then file a non paying bidder charge.
i recieve a message from ebay that i have paid them via paypal and no further action will be taken against me.
the seller has apparently given ebay details/tracking of my parcel and ebay say that is fine.
the seller still wont respond to my emails and after repeated requests will not give me the tracking details or tell me where it is.
i paid the seller extra for insurance.
so what do i do now???? i am now £57 out of pocket.

Hmm... do you still have time to do a Paypal chargeback? I can't remember if it's 30 or 90 days. If I remember correctly Paypal require the seller to produce proof of receipt rather then proof of posting for them to stop a chargeback.
If you've run out of time on the chargeback then your best bet is to pull the seller's contact details and speak to them directly to try and find out what's going on.
It's possible your parcel is delayed in Customs somewhere, but nevertheless, you've already waited far too long for delivery.
If you've paid for insurance and the item has gone missing then it's the seller's responsibility to give you a refund then get their costs back via the insurance.0 -

yes i done a chargeback about 10 days ago,but in my outstanding dispute details on my ebay there is nothing on there outstanding?
i think it is 60 days from the end of auction to do a chargeback,if i remember right.
so i have about 10 days left to get another chargeback in.0 -
Log into your Paypal account and check there. I could be wrong, but I don't think Paypal chargebacks show in My EBay, you have to go directly into Paypal itself.0

here are some details left by paypal regarding the sellers response.

they have a usps shipping proof but when it arrives in the uk it must be transferred to royal mail or someone?
looks like the seller has provided proof of delivery for usps only ?0 -
Personally I'd carry on with the claim as the seller is being most unhelpful.
If it does arrive, you can always pay again.
Like I say I think Paypal require proof of delivery rather than shipping, until it arrives I the seller can't prove this.0 -
looking at the sellers feeback they have alot of negatives,but they are a powerseller and do sell lots and lots
i did e-mail a previous buyer who had there item go missing and left a neg.
they told me they had not recieved theres still after 3 months and paid insurance and had not had a refund from the seller.
what i cant understand is why the seller wont give me the tracking number so i can do some phoneing around and see where this package is?0 -
To be fair USPS is normally very good but I had two lost over Xmas that took a month.
Anyway if i were you continue your claim, you have nit signed for it so he will have no proof of delivery. Just keep pushing.
The bonus is as a big seller he will not be able to cut and run so you will get your money bacck eventually (I hope)0 -
I may be being overly paranoid here but.... is it possible that the seller has not actually posted it out to you?
If Paypal ask him for a tracking number, he can easily make one up.
Maybe this is why he won't give you the number. Paypal won't check a tracking number, but the seller knows you probably will, so he's ignoring you.
Like I say, I'm probably just being paranoid. But why else would they withhold the tracking number?0 -

i think the seller may have not sent it i dont know, looks strange though?
i was notified the item was out of stock after i purchased it and noticed the seller has not sold a single same item since my one.
plus the fact they wont pass on the tracking number.0
