Credit card taking money without notification?

Hello, I need a bit of advice please as to whether a credit card company can do what’s been done to me and I’m hoping someone on here might be able to help.

I have discovered today that Barclaycard have taken a payment from my current account (which is also with Barclays) for £249.17. My agreement with them to pay £60 a month (via standing order from my joint account) so when I rang up to find out why this payment had come out they said it was because the standing order had been cancelled on 2nd March (which I didn’t do) and no payment had been made on the account since 6th April (how can this payment have been made if the SO was cancelled?) and that legally they can take the money to bring the account back up without any notification to me.

So my question is can they just take a random amount from my bank account without telling me? Also the Barclaycard account is in my maiden name and my current account in my married name and I have never made a payment to them from this account so how can they get the details without asking me?

I’m waiting for my bank to ring me back and tell me who cancelled the original standing order then I shall be back on the phone to Barclaycard and I am fuming that they can just take this money without any notification!

    Are you saying that you did not set up a direct debit facility between your credit card and the current account the money was taken? If this is the case, then they are not allowed to do that.

    If you do have a direct debit facility between your credit card and the current account the money was taken then you have to check in the agreement whether it allows 'variable' direct debit or 'fixed' direct debit.

    If they are in breached of your direct debit agreement, then you have the right to claim the money back .
  • I'm 99% certain that I have never had a DD set up to pay them from this account. However someone on another board as advise me that there will have been in the small print of the card agreement a clause that allows any debt with one part of the organisation / group to be claimed from money you have with another part of the organisation / group. I'm still amazed that they can take the money without even notifying me though.

    I've had some other advice from the CCCS who say that yes they can do this which is why your bank account should be separate from any that you owe money too but I still don't know why the standing order was cancelled or how a payment was made after it was cancelled.

    they can do this. unfortunately the same thing happened to me at Lloyds TSB. had a credit card with them and an account and they took money from my account as they pleased. It will be in your terms and conditions with your Barclaycard. maybe you should put your bank account with someone else?

    If you have more than one account with a bank, they can rob one to pay the other. A very good reason not to have your credit card(s) with the same organisation as your current account (or savings account).
