I purchased 4 tickets from GETMEIN for the Kaiser Chiefs @Leeds (14th Feb 2015) for block 104 (stated on the invoice) and paida premium of £350 in total with the fees, ok a lot of money but my kids and I reallywanted to see them @Leeds. When the tickets arrived 4 days before the gig thesewere for block 329 (which on the 12th Feb I could buy from GETMEINfor £40) I have contacted GETMEIN every day since receiving the tickets and getfobbed off every time finally to be told on the 14th Feb as this wasthe day of the concert, it was too late to do anything and to email the disputes manager on the Mondayafter reading various threads I am concerned that they are not going to assist whatare my rights as a buyer I used my credit card to buy them, but did use thetickets because we had pre-booked the hotel.

WRITE to them a Letter Before Action stating what you want them to do (refund the difference between what you paid and what the actual tickets were worth?) and in what time frame (17* days from date of letter?). Mention also that this LBA will be followed by small claims court action if they don't provide the refund in the stated time frame, and the cost of bringing the claim will be added to the amount claimed. Send this letter 1st class via the Post Office and get a free certificate of posting**.
If they don't respond (either at all or favourably) then raise a small claim (MCOL). You could also look at raising a Section 75 claim against your CC provider for the difference you are claiming, due to the seller's breach of contract.

** Interpretations Act 1978. A letter sent 1st class is deemed "served" (delivered) 2 working days after posting. The certificate of posting is proof that a letter was sent to the stated address on the stated date.0
