Car fault within warranty period, fixed outside

Hi, we reported a fault on our Renault Grand Scenic at the end of March 2014 before the warranty expired. It then went into the garage a further 4 times until the problem was fixed in Jan 2015. Sometimes they had the car for two weeks.They had not been able to locate the problem using error codes and had tried different things. Eventually, they have changed the clutch and we have had to pay 10%(£342). Can I and how do I make a claim against them in the courts. thanks.

Why have they said you were required to pay 10%? As it needed a replacement clutch to fix the problem might they be saying that your driving style contributed to the problem therefore you have to contribute to paying for the fix?

No, they said it was a different fault even though the symptoms were the same every time. How do they know it was a different problem if they couldn't find a fault in the first place and just tried re setting the gears as a solution. Below is the dealers booked in report.




08 April 2014 Automatic gearbox reprogrammed

- 09 June 2014 Automatic gearbox drums repositioned

- 28 July 2014 Consultation with Renault technical and checks of gearbox computer and reprogram

- 24 November 2014 Consultation with Renault technical replacement of the clutch and actuators

Also, car is below average miles, driven by my wife mainly with our children in the car and she is not a speed demon. 1.5 EDC gearbox

Ah well, telling us now that it's an automatic makes a difference.
