Solicitor not on approved list, what now?

Our FA appointed a solicitor to deal with a re-mortgage of our current property and a mortgage of a new property.

The solicitor is in the approved list for the re-mortgage lender but not for the new mortgage lender. Their application to join has just been rejected. I have already paid a fee for searches etc to the solicitor but now we have had to change solicitors.

Anyone know what happens in terms of the money already paid? the solicitor said they have already submitted the searches and they have had documents from the vendor solicitor's already.

The FA is going to find out what happens now but any ideas would be great.

    Either you switch solicitors for your purchase to one who is on your new lender's panel, or you stay with your existing solicitor and the lender instructs a panel solicitor to represent them (if the former, you may have fees for the work done so far; if the latter, you will almost certainly be expected to pay the additional legal fee for the lender's solicitor - though the searches etc don't have to be duplicated).

    Hi davidmcn, we have already switched solicitor, my question is what happens with the fees I have already paid and the searches already done. I didnt appoint the solicitors, my FA did so surely they should have checked that they were approved? The money paid so far has been a deposit so they can start the searches, does this mean they can just transfer what they find?

    At some point either the FA or the solicitor should have known they were not on the approved list, surely I cant be expected to pay for this twice?

    You may have been introduced to them by the FA but they're your solicitors - you've given them instructions and money to do work on your behalf. Have they sent you their terms of business? If so, what do they say about the costs? Searches can be transferred.

    Ask the old solicitor to pass the searches to the new one?
