Returning goods and cancelling credit agreement

I'm hoping someone can assist us. My husband went to Currys PC World the other day to buy the new Lenovo tablet. He was told it wasn't in stock for them to show it to him, but if he paid for it they could order it in. He didn't have the money to buy it outright and wanted to take out a finance agreement. He was told he could not do this with an out of stock item. He cose another tablet and was again told it was not in stock, so he bought the new iPad air 2. He took out the finance agreement and brought the iPad home. He tried it at home with our wifi and found it to be slower in some respects than his old one and decided he wanted to take it back, also there was an issue with them adding insurance cover to the total cost to finance, meaning he would be paying for an insurance cover for three years which he didn't need. He email Currys and received a call from customer services today who told him that as he had bought the iPad instore and had taken it home an used it, he is not covered by any law that will allow him to return it. The issue we have is that the finance agreement needs to be changed as the insurance needs taking off, and the only way we can canel the finance is to return the goods. We are just in a vicious circle and don't know what to do.
Please can anyone offer any advice? Thank you

so what do they say will happen if you do return the goods?0

I'm sure their returns policy is for unopened items only (unless faulty) so there will be no automatic right to return the iPad. To be fair I can't see what the shop have done wrong, your hubby went in looking for an out of stock item, he was told it was out of stock he then had the choice of leaving and buying elsewhere or looking for an alternative.
Currys don't sell insurance but I'm guessing it's their product support that has been put on. If you want to cancel that part of it you should be able to go back to store, they would then have to redo the finance agreement without the product support on so its not a cancellation as such but an amendment to the original agreement.
When you say the iPad is slow on wifi what exactly do you mean? If it is faulty then there is a right to return it and cancel the whole lot. How does the speed compare to the in store demo model? Not liking it/thinking it is slow isn't the same as faulty though.0 -
I am a bit confused here, I thought that the Currys product support thing was paid monthly as an ongoing thing via DD, not added to the cost of the product and put through the finance?
And I have to say, this sounds more like a change of mind rather than a product issue, in which case the store legally don't have to do anything.0 -

PPI scandal anyone?
He's used it and can't demonstrate there's anything wrong with it so he's not covered by the SOGA in terms of returning it. It's up to Curry's whether they'll refund him if he simply decides he doesn't want the laptop any more and it sounds like they won't. Fair enough.
Your other issue is more worrying. Banks severely got their knuckles rapped not only for selling people insurance that was unsuitable but adding it to a loan so that interest was charged on it. What does you finance agreement say with regard the money you've spent? Does it list the price of the item? Does it list the cover separately? Have you made any payments yet?
Don't talk to customer services. Write to their complaints department explaining that you want the premiums for the insurance taken off. You're under no compunction to buy this product, and it shouldn't form part of the loan. Not unless Curry's wants another PPI scandal on its hands."Growth for growth's sake is the ideology of the cancer cell" - Edward Abbey.0 -
If its slow on WiFi take it tp the store and test on their WiFi.
or test on any other known working WiFi .
Insurance are you not allowed something like 30 days to cancel ???
Might be worth asking on the insurance or credit boards .0
