    The council policy has no bearing on the matter, it's covered purely by legislation and case law. Assuming what he's told you is correct re his council tax then it's one of the more straightforward queries to actually deal with. I would go as far as to say that the advisor you spoke to seems to be out of their depth with the query,
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    I had a lodger for a few months of 2014 who had a main address in Preston. I had to provide a copy of his council tax document from Preston which showed that he was paying the full amount there. Then I had no problem.

    Is having a lodger classed as business in any way? Could the council charge business rates for the premises?

    Absolutely not! I for one would immediately give up letting my spare room if I had to pay business rates! So would many others. There is an extreme shortage of affordable housing now. For me it is a top up to my public sector salary so that I can afford to maintain my house.
