help - ebay I closed a refund by accident

Please help.
I have purchased an item from ebay. Item was delivered to site and used. Item then breaks down and husband then notices that item is not the model/spec that was ordered. Then I checked sold listing and contacted seller. Listing and photo was for the item I thought I was buying, but invoice was sent for lower spec model. I went on ebay to check where I stood. I then opened and closed a refund case by accident as I wanted to contact eBay first so I knew for sure the seller had listed the item in contravention with the listing policy. eBay have contacted the seller. He doesn't think that he has done anything wrong....eBay say they cannot help as a refund case cannot be reopened. Any suggestions or anybody have any experience that could help?
Martin what do you suggest next??

    There is very little you can do now except to appeal to the sellers goodwill.

    Ultimately of course you do have the right to use UK law/small claims against the seller.

    OP if this was a B2B case then your 'rights' are very different and small claims may well not be possible.

  • Sorry what is B2B sale? The actual goods are faulty so I still have Sales of Goods act Protection don't I?
    It is something that I should seek advice through with my Legal cover on my house insurance?
