If you do go to small claims court then costs should not be much even if you lose.....
The minimum court fees over a hearing over a claim for the 50% of the OP's excess (£75) would be £50

Up to you, but I wouldn't go to court over £75. It's downright annoying, yes, but I'd write it off and move on.

I thought he was going to court to get the full cost of everything from the TP's insurers and thus get his NCB reinstated but perhaps the OP can confirm this? If not maybe he can claim the £75 plus the increase in insurance premiums for the next few years if that is possible to estimate.

Were that the case, the minimum court fees the OP would have to pay in advance for the hearing would be £520 (for a claim in excess of £3000).

Hardly "not much even if you lose" as you advised! (And doesn't include any allowable expenses for the other side)
