Faulty iPhones Help

I hope that you can help me with some advice. I had an iPhone 5 given to me as a gift a year a go and it developed a faulty camera. So, after lengthy discussions and visits to Apple stores, they replaced it. The replacement iPhone 5 had a faulty battery, so after even more lengthy discussions, they replaced it again.
The third iPhone 5 has the same camera fault as the first. When I contacted Apple to let them know, they said it is now out of warrantee. After lots of discussion, I argued that it can’t be as they keep sending me supposedly new iPhones that have faults.
I am concerned that they are replenishing the phone with grade B products. They have not offered to replace it the third time, so I have asked for a refund, which they refuse. Now they are not responding to my email and using excuses about US timezone issue.
I have spent literately days over the last year in discussion and changing software and resetting phones and replacing them that I am getting really tired of this. What rights do I have for a refund as I don’t have a receipt?

If not it is extremely unlikely that you will get a refund from Apple... even with a receipt.
Any rights you may have are with/against the seller.
In fact even that isn't quite right.
As you weren't the purchaser, then technically you have no rights with the seller.
Warranties are in addition to statutory rights and can have restrictive terms in them. The manufacturer owes you, or the buyer, nothing beyond the warranty terms.
Without a receipt, or other proof of purchase, you or the buyer have next to no chance of getting a refund.0 -
Apple are very clever, when you buy direct from them they tell you to go away, when you buy from a third party retailer they agree with you but tell you to take it up with the retailer., either way it's not their problem.0

You never get a new replacement - always a factory refurb. My 6+ camera was faulty on arrival, and was immediately replaced with another new one as their warranty applied.
Unless you took an extended warranty, your period of cover does not restart with each replacement, so wanting a refund because of these issues would be on a goodwill basis only, not a right. Since there is no inherent fault with the product, your ability to prove them at fault will be impossible.0 -
Warranty on Apple devices are managed by Apple. Period. While the contract is with the seller in all cases the seller should refer you directly to Apple since they offer a service which exceeds current legal requirements.

There are a few points to note: not being the original purchaser of the device is not usually an issue with Apple. Devices are identified via serial number and it is this which is used to determine their warranty status. I have personally exchanged faulty devices purchased abroad and devices purchased by another individual without any problem whatsoever.
In terms of the warranty provided on replacement parts or products Apple is very clear on this:A replacement part or product or a repaired Apple Product assumes the remaining warranty of the original Apple Product or ninety (90) days from the date of replacement or repair, whichever provides longer coverage for you.

The point being that you will always have a minimum of 90 days warranty on any replaced or repaired product.0 -
To be honest, we have taken iPhones to the Apple Store (by appointment) that haven't been purchased from them, and they have always repaired them, without hassle, or replaced them cheaply.

My daughter just got a new phone out of warranty from the Apple store. She called someone at Apple care in America lol. They sorted it for her the battery had swelled..Maybe worth you trying them?0
