Tenancy Deposit

I rented a house through an agent and left in December 2014, the agents and landlord inspected the property and agreed it was in good order. I patiently waited for my deposit and today have been told by the letting agents that I need to apply to a Government department and they will apply for an ID for me so can do it. Is this correct, I understood that the agents were responsible for returning this?

    You should have been given information regarding the tenancy deposit scheme at the start of the tenancy.

    It is not a Government Department, it is a Government authorised protection scheme.

    Assuming you are in England or Wales........

    You need to contact one of the deposit protection schemes and reclaim you deposit.

    The landlord was required to provide the prescribed information telling you which scheme at the start of the tenancy.

    Did they do that?
    If you've have not made a mistake, you've made nothing
  • All I received at the beginning of the tenancy was a receipt for my 400 pounds

    There are several schemes. Check each one to see if your depoit is registered, and with which one.

    Deposits (Rules on deposit protection)

    If registered, make a claim to the scheme for your deposit.

    If not registered, write to the landlord and copy the agent, pointing out they failed to register the deposit as required by the Housing Act 2004 and that unless you receive your deposit in full within 3 working days you will apply for the penalty of 3 times the deposit.
