    This is good assuming that the reader can't be damaged by the user.

    I'd send a Letter Before Action to EE (copy of the report enclosed) giving them, say, 10 days to collect and repair the phone and threatening them with legal actions otherwise.

    If they fail to do this, I'd submit a claim to the SCC for the cost of a replacement phone (or Apple's repair) plus compensation for the trouble EE caused: Small Claims Court
