John Lewis - Maclaren quest

Over the weekend the internet went mad with news that John Lewis were selling off Maclaren Quest buggies at £40 a pop.
I jumped all over it, needing a buggy for my child.
News then started circulating that JL weren't going to honour the orders.
Today I received the following e-mail

'You recently placed an order online for a Mclaren Quest Sport 2013 pushchair. By mistake, this discontinued product was uploaded to our website at £40; the last selling price was £135.

We're very sorry for this error and we hope you understand that it is not feasible for us to supply this product at the incorrect price that was showing when you placed your order. Therefore we have cancelled your order.

We have not taken payment for those orders that were placed using a credit/debit card/PayPal, however, we will have ring fenced the total order amount and it may take up to 5 days for this money to appear as available funds in your account. If you placed the order using a gift card/vouchers then we will refund you via an online credit.

To apologise for any disappointment or inconvenience our error may have caused we have processed a credit of £25 for you to spend when you next shop online with John Lewis using the same email address used to place this order."

I have done a bit of research and there are other e-mails circulating that were sent earlier in the week stating this was just a pricing mistake, not that it was discontinued.

As much as I appreciate £25 credit, you can't get a Maclaren pram from JL for anywhere near £65. I have checked JL's T&C's and that states they have accepted my order until I receive a confirmation and they only send this once it's been dispatched, they only send an 'acknowledgement' upon order.

I suspect that they did mean to put this up for £40 they just didn't expect the frenzy they got and and that now probably leaves them massively out of pocket should they honour it.

Do I have any leg to stand on in this fight?

  • No, you don't have a leg to stand on. You tried to grab a bargain, unfortunately didn't work, you are not out of pocket (in fact you are up on the transaction). Move on.

As you've researched yourself - no contract exists until they have accepted/confirmed the order.

On the bright side, you've managed to gain a £25 discount in the process :)
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride
  • Never mind, if you pop along to the Bridge, a local ale house near where I live, they have a promotion on at the moment. The current offer is:

    Free Beer Tomorrow

Alas, I am afraid, Tomorrow never comes, it is always today!
  • thanks for the replies, even the sarcastic ones!
