Noisy neighbours- Help!!!

Hiya, so we moved into ground floor converted flat (two flats in one period proprty) late last year and its been lovely mostly until start of this year when new owner upstairs who is renting out his flat had tenants there probably month before we moved in and OMG the guy works out (feels like an earthquake!) and my light fitting shake but he's only started working out late last month. I've already called landlord about this as I'm concered the whole thing can cave in but also ruins our evening. he said he spoke with them but they are still doing it!!! We are both share of freeholders so is there anything I can do to protect myself on legal stance if that idiot upstairs continues on?

Your post is a bit confusing, it would be clearer if you used punctuation. Do you mean that the guy upstairs is working out with weights and dropping them on the floor?
  • Could be a treadmill or similar. If used on a hard floor these machines can make a lot of noise but I believe you can buy special mats to reduce the noise.

Sounds annoying, however the question from a legal perspective is 'is it reasonable'.

Could you agree with them a time when they can do it when you are out the house? Normally these things are best sorted by being friendly and not making the other person get their back up.

have you spoken directly to the man upstairs rather than via the landlord? Maybe he doesn’t realise how noisy it is and would stop / stick to certain times if you politely explained?

I had a noisy neighbour and he was heard of hearing. He didn't know how bad it was for us and stopped as soon as we asked him.
  • I too would approach the tenant direct and discuss it with him. He may not realise how it impacts on you.
If you change nothing, nothing will change!!
  • Ask him again politely. If no good, you have a right to quiet enjoyment so inform the landlord or Council. Do it soon before he gets too ripped just in case there’s trouble lol.

Quiet enjoyment is the right to freely live in and use your home without interference from the landlord and their agents. Nothing to do with noise from neighbours. You could speak to the noise abatement team but unless the noise is unreasonable, loud or between 11pm and 7am they might not help.
Don't listen to me, I'm no expert!
