Redundancy money not received

Hi,

I've worked for my employer for 2 years and 2 months. I received
a letter from him on the 5/11/2014, stating that the department I
worked in would be closing and my role would be made redundant.

I received a letter on the 5/12/2014 stating that I would receive 2
weeks redundancy payment and my final salary payment on the
31/12/2014 - my redundancy date.

On the 31/12/2014, I received my final salary payment but no
redundancy money. On the 16/1/2015 I received a letter stating
that the redundancy money would be paid within the next few
days. It is now 8/2/2015 and I still haven't received my
redundancy payment.

Can my employer delay my redundancy payment for this length of
time ? I'm not sure if he has any intention of paying me.
Does anyone have any answers and advice please.....

I would suggest that you write (paper and ink) and get a proof of postage. Keep a copy of the letter.

In the letter, remind the employer that that the payment was due on 31st December. If you know, set out what the sum due is. (either in cash terms of in terms of your pay - i.e. either say "redunadancy payment of £1,000" (or whatever the figure is) or "redundancy pay equal to 2 weeks of my normal gross pay"

Provide your bank details and ask that the payment, plus interest since 31st Jan. is paid immediately.

State that the letter is a formal request for the debt to be paid.

I persoanlly would include a deadline, saying that if the payment is not made within 7 days you will be making a formal application to an Employment Tribunal, however if you prefer, you could wait to see whether they pay up on receipt of the letter

Meanwhile, call the ACAS helpline 0300 123 1100, or the Redundancy Payments Helpline (Telephone: 0845 145 0004 ) for further help.

(I am not sure whether you'd be entitled to any interest, but asking for it may put some pressure on the employer. I would suggests including your bank details as this makes it harder for them to claim there is any delay due to any difficulty in paying you)

If they do not pay then you are entitled to make an application to an Employment

ETA - be aware that you must make any application to a tribunal within 3 months of finishing work, so you only have until the end of March

Employer stated you will receive 2 weeks of redundancy money - correct only if you are aged less than 41. Statutory redundancy payments cap what a week is worth, so you may not get full wage. (Of course, your employer may be planning to pay you more.)

Its actualy 42, you need a full years service over 41 to qualify for the extra 1/2 week

Thanks to all for the excellent information and advice.

I have now used the 'www.gov.uk/calculate-your-redundancy-
pay' to work out my redundancy pay. I have completed a letter
to send to my former employer as suggested (thanks TBagpuss).
