Last year when in one of my wild period of mania I gathered together all the money we had about £15,000 including maxing out our credit cards and we went abroad for 6 months. (seemed like a good idea at the time)
Surely an OR in bankruptcy will question this? Have I done anything illegal?0 -
If, at the time of the splurge, you were patently Insolvent, then action can be taken.
The OR will see what has happened, and may look at setting a BRO/BRU in place. [Much will depend on whether the OR [or the Court] feel you provide a risk to the public?}
At every stage of a BRU/BRO, you are able to provide evidence which you may feel will have an impact on whether a BRU/BRO is applied, and for how long it remains in place.

No - its not illegal as such but - if you made use of credit you realistically knew you would not be able to repay then the OR will ask you about it and they may put some restrictions on you like a BRU/BRO. Don't let this put you off dealing with the debt though, its not the end of the world. It sounds like you are going to have to evidence your mental heath problems and explain what the impact has been on your finances.0

I am more than happy to provide evidence of my mental illness and take full responsibility for the crazy idea of going on holiday for 6 months, along with whatever the consequences.
Hopefully they will not persecute my wife because she went along with the idea.
