    Just leave her to put that you were in her blindspot on her claim and will more than likely be help 100% to blame.

  • Hi all. Thank you for all the replies. Our claim forms went in months ago and I did stick to only the facts and things I could see. I agree you cannot get emmotional and think you get caught out if you lie. In all honesty I thought this was done and finished but the letter last week has really annoyed me because I don't understand her grounds of appeal, presuming it is her that hasn't accepted the decision of her insurance company. I hope she said on her form that I was in her blind spot!

    I read the comment about similar accident resulting in a much worse outcome and we were not far off. " Thankfully" she hit my front wheel and not the rear because I could see mmyself hurtling off the road side ways if she span me out at the back. That would have been nasty.

    It may be that the other ins company will drag this out until past your next renewal in the hope that you'll see the massive premium hike and fold to accept 50/50.

    What you do is up to you, when I had my accident I stood by my guns and it cost me more in hiked premium than it would have been to pay the silly cow for a new wing mirror and to sort out my own car myself.

    Don't worry op - there's very few scenarios insurers won't dispute. Typically a rear ending is open/close. And if there are life changing or fatal injuries I suspect they'd be more cautious as they don't want bad press - but otherwsie this is far from being a new tactic.

    Did you do that? check no-one was overtaking you, indicate right, then overtake?
    Did she? Looks like she didn't look properly at least, and if you can say that she didn't indicate that's another mark against her.

    For an overtake you use MPS(+G)L then MSM - MPSLMSM basically :)
