  • Its only three months until the money is released. Try and see if the 'difficult' trustee will sign the money out early, but if not, confirm exactly when the deposit money will be in your bank account if left til May. Then speak to the vendors and find out if they are prepared to wait. Make sure there will be no further problems with the deposit.

    If you are entitled to the money on your birthday, then it is the trustees responsibility to ensure that happens. If they delay on this, they should bear the costs. I can't see how they have a right to vary the will to prevent you getting the money on your birthday.

    Wee have not been told the details of the trust. Some trusts have a degree of discretion of the trustees as to whether they allow access to the money.
  • Hello everyone, thank you for your honest replies.

    I believe the financial advisor is in the process of speaking with the trustee so we shall see what is said there. Thans for all the helpful comments. After the first three comments yesterday I ended up getting myself in a right state, and have now actually found someone that is very lovely and offered to bridge the money if there is a delay, therefore house should be fine. Obviously I am eternally grateful to them!

    Having spent three years studying trust law, it is still quite tricky and so came on here wondering if there were any other options. Massive learning curve, and thank you again to those who have provided useful and supportive comments.
