I would tell her to issue a warning he must desists from harassment which he will ignore and she can then send the police round to issue him one which he must sign as received or face arrest.

Don't be so silly. Informing someone by text, that you intend to issue a county court summons, is not harassment.

Send the police around? Have you tried ringing the police in the last twenty years? They wont leave their tea 'n' biccys at the station for that.
  • He has emailed and outlined the costs he wants. If she doesn't give him the money by the end of March he will take out a claim at the small claims court.
He told her not to contact him, just send a cheque or cash.

This is a regular topic on Judges Judy and Rinder. (I know, I know. I have a sad life!)

Usually the claim is thrown out as there is no intention to create legal relationship

Wait for the county court summons which probably will never appear. If it does come back the.

  • I actually watched it today!! It is so upsetting for her.
If he had spoken to a solicitor today do you think he would have been advised to email her or has he taken that upon himself??

Yes it is, the correct process is to issue a Letter Before action, not pester someone with text messages.
The intention is obviously sour grapes and bitterness and the action is intend to cause alarm and distress.

The Idiot must know he wont win a claim under sour grapes for a holiday and the friend of the OP is entitled to have this idiot refrain from harassing her by text messages.
If he ignores the warning it becomes a malicious communication as well as harassment.
If this prat thinks he can sue, he should issie a LBA and county court claim, not harass the OP's friend by text messages.
I do Contracts, all day every day.

Bung the expression into Google and you will find many links. Sorry I have a new tablet and I am having difficulty in providing links.

  • What does 'no intention to create a legal relationship' mean?

It means that a verbal agreement is not a legally binding signed contract and therefore has tiny tiny legs and will likely fall over in court and get its face covered in muck.

    Essentially.

  • Thanks again to everyone who has offered advice/comments on this. I suppose all she can do is wait for the letter and go from there.
