Hello members
I want to surrender my tenancy by giving a written notice to managing agent. The rental agreement was signed by my wife and myself. Is it acceptable if I sign the notice letter on my own or does it has to be signed (legally) by both me and my wife.
Thank you for your help

Both of you...(ideally)..0

Ideally yes but either party can terminate a tenancy agreement by giving the correct notice.:footie:
Regular savers earn 6% interest (HSBC, First Direct, M&S)
Loans cost 2.9% per year (Nationwide) = FREE money.

If I was the LL I'd like to be sure both of the named Ts were planning on leaving. Is there any reason your OH can't sign it too?0
-
Or get someone to sign on her behalf (pp it..)0

A joint tenancy is ended by either party terminating the tenancy. So, either of you can sign.0

A joint tenancy can be ended by just one tenant.
When you say you want to surrender your tenancy, what do you mean by that? Do you have a fixed term tenancy or a periodic tenancy?0 -
Hey! Stop!
We need more information before answering!
Is the the tenancy in a fixed term? Start date? End date?
Is there a 'Break Clause'? What exactly does it say?
Is the tenancy periodic ('rolling' or 'monthly')? What are the start /end dates of each period?
Whether one or both of you need to give notice depends on the type of tenancy - so give us the details.

Thank you so much for quick response
We signed the contract on 12th December 2013 for one year. We are now in periodic tenancy because we did not renew the contract as we weren't sure we will be living in the same are for the next year.
Reason is quite crude basically as you can see notice date is fast approaching I wanted to print off the notice on Monday at work and post it. If both of us has to sign then I have to bring the letter back home to get my wife to sign and post the following day.0 -
In a periodic tenancy, only one of the joint tenants needs to give notice - this is binding on both.
But notice must be valid - see the link provided above.0 -

You could just hand write it0
