Are CEL Vexatious Litigants?

The number of times they fail to turn up, surely this must be a proven status by now?

    Its a shame the courts dont give them a charge for hissing them about.
    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:
  • I posted a query on Mr P's blog as to who it costs when they don't turn up. Seems the £15 or so they pay in covers it.

    Be interesting to uncover the details for the bigger picture.

    We'd all like to think so. However, they probably win enough default (undefended) cases to allow them to justify their actions.

    I would hope they wouldn't count the number of default (no-show) wins a litigant gets when determining if they are vexatious - you don't even need a case to win there!

    I'd also have thought any litigant that failed to show up (why the bleep are the litigating if they aren't going to show up?) would be suitably penalized or at least blocked for a while.

    Especially when they seem to lose most of those cases that are actually defended.

    Its a money thing.

    They take £20k a week from people scared and bullied into coughing up before the earing

    They lose £3k a week by not turning up to the few hearings where people want to go all the way.

    Individual judges have no idea what is happening, and even if informed, very little interest in following up. Thus, CEL get away with it.

    How would you go about getting them declared as vexatious?

    Another thing that should be happeneing is that in the Co-op cases the co-op should be given plenty of bad publicity for all of this, even though they have fallen out with CEL it is they who are responsible for this mess in the first place.
    and the same goes for any other PPc they get in bed with - aim all bad PR at the Co-op
    From the Plain Language Commission:

    Are their claims "Without merit"?

    Not turning up equals a simple victory for the defendant. However the merit of their claim is never decided, to be a vexatious litigant you need to be shown to be making unmerited claims.

    Unfortunately unlike wasting police time wasting court time seems to go unpunished.

    Hello all
    Just to update you all with proceedings from today.
    As expected CEL didn't turn up in court today, in fact they sent a cowardly email to the courts yesterday at 4pm to say they were dropping the case (So a win in my situation)
    However they failed to contact me via any communication (Which is their responsibility)
    As I had turned up at Court, the Clerk kindly told me to submit a letter to the court with regards to claiming out of pocket expenses as they hadn't informed me in due time.
    So thank you CEL for an easy victory - For anyone else contemplating whether to pay these cowboys, then quite simply DON'T.
    Thanks to everyone on pepipoo who assisted during these proceedings.
