Capital One PPI rejection

Hello

I have been rejected by Capital One for my PPI Claim (Final rejection), I'm looking for a way forward, hope you can help.

I applied for a cc in writing and did not tick the insurance box (I have a copy of this sent to me by Capital One). I agreed to PPI during a call to activate the card. I was told that they would not open the account without me taking out the insurance, it was my first cc so knew no better though I felt bullied into it.

Now Capital One tell me I had all the information and could have cancelled at any time which may be true but I thought the agreement was all part of the same credit agreement.

Anyhow - anyone out there in a similar predicament? Should I go to the ombudsman or try again with Capital One?

What do you think?

If you can get a transcript of the call where someone said they would not open the account then yes I would agree with you that a complaint should be upheld.

Presumably you have already tried this and they have rejected it. Did you mention the content of the call in your complaint.... and did they look for the transcript.

Other than that, you have no proof that it was said
make the most of it, we are only here for the weekend.
and we will never, ever return.
  • Nope, can I get a transcript? Or ask for one?
  • Cap One rejected me too and said that I had enough information to make an informed choice. I took this to FOS and they upheld my claim. Cap One wrote to them saying that they did not agree and wanted it sent to the Ombudsmann ( it was adjudicators that upheld it ) The adjudicators assessed again and still agreed it was mis-sold. That was two years ago and I am still waiting on Ombudsman decision but have been told it is very unlikely that it will be rejected.
If I was you I would send on to FOS but don't expect quick decision as they are snowed under apparently

The ombudsman only tend to overrule around 11% of adjudicator decisions. However, Cap One have a very low uphold rate at the FOS (the FOS reject most of theirs). So, something has to give.
