Section 172 help

We have recently received a section 172 in regards to an alleged accident we had. I say alleged because my husband was driving the car that day and at the time of the alleged accident it was actually parked in his company car park and he was sat at his desk working. This was about 50 miles away from the site of the accident. We have now received a section 172 requiring us to state who was the driver at the time, as no one was driving the car, what is the correct answer to put. Can we put unknown? As they are stating that it's an offence not to state the name of the driver, but how can we put one in when it wasn't being driven.

Simply write the info you have posted on a seperate sheet, sign it & staple it to the s172 request.
Return by recorded delivery or get free proof of postage from the PO.Always try to be at least half the person your dog thinks you are!0 -
What do you mean "we"?
If it's addressed to you, you need to respond that your husband was in charge of the car at the time. He will get his own letter in due course.
If it's addressed to him, he needs to state uneqivocally that he was the driver at the time to satisfy the s172 request, but as said above make it clear that he and the car were elsewhere.
It's probably a simple mis-read of a reg number, but it may be something more sinister like cloning.0 -

I have just been given some advice by a policeman who has told me to put no one in the second part ie if you were not the driver who was... As it wasn't being driven and was most defiantly not in the area at the time. Hopefully that will be the end of it.Wins

I would still attach a covering letter explaining everything. Failure to fill out the form correctly usually carries 6 points and so many people try to get out of points / fine by not filling it correctly so they'll need a very good explanation if parts are left blankAll your base are belong to us.0

You are confusing two issues as one,
1) Who was in charge of the vehicle at the time?
2) being involved in an accident is a seprate one.
Perhaps the plates have been cloned , however in the meantime, complete the forms as required.0 -

That policeman could get someone six points and a large fine.0 -
The question asked is who was the driver,at the time of the alleged offence not who was in charge. If it was parked in a car park then no one was driving it. Same as if it was parked on our drive.Wins

You can keep asking until someone posts what you want to read, however the thread already includes what you need to do, the questions are quite simple, who was in charge of the car at the time of the alledged incident? Was the person in charge incolved in an accident at the time?0 -

Is there evidence that the car was at work with your husband as well?
Just in case they think someone else may have been driving it who wasn't you or your husband.All your base are belong to us.0
