Need some advice with my insurance
I was on my way home from work on January 17th and while I waiting at the lights I was hit from behind by a tanker that had entered my lane and proceeded to scrape the whole side of my car. I got the drivers details and contacted my insurance company to report it but as of today they haven't had a response from the driver.
It then came time to renew my insurance but as my current provider had put it up by quite a lot I decided to go elsewhere. So I went online and found that because my accident is at this time unresolved I was getting ridiculous quotes.
I eventually found an insurance company that was more reasonable and paid my deposit, only to have a phone call a few days later to say that they were cancelling my insurance due to the accident not being resolved (they also decided they would keep my deposit)
Now I really have no idea what to do, I even tried insuring my mothers car which is worth no more than £500-600 and was getting quotes as high as £9,500 a year for my insurance.
My vehicle is a focus ST and before this my insurance was only £45 a month, I can now not afford to insure it through no fault of my own and also have to declare that I have been refused insurance when I get a quote which bumps it up by hundreds of pounds.
I'm really stuck as to what to do and I'm worried if I put down another deposit I could be refused again and lose even more money.
Any help would be greatly appreciated

For starters, where were you refused insurance?0

The company who refused my insurance was "flux direct"0

If it was me, i'd have stuck with the same company because it's easier later.
Just now because the claim is unsettled, it goes the same as an "at fault" claim.
Once / if they recover all the costs from the liable party (truck driver) they will then close the claim and mark it as a non fault.
At this point if you have been paying an increased premium, the insurance company you're paying it to should be giving you a refund because that increased premium was based on you being at fault.
It's this part that usually is a lot easier when sticking with the same company. All your base are belong to us.0 -

You need to identify whether you have been 'refused' insurance or whether they incorrectly quoted you and with drew their offer, that's a real concern.
Once that is resolved I'd go back to your current insurer (previous one? the one that is dealing with the claim) and get insurance with them, this will cost you more but you should be able to claim the difference back off them once the situation is resolved. I'd be really pushing flux to write to you that they didn't refuse you insurance but had incorrectly quoted you, I'd also be pushing for my deposit back. Having insurance refused or cancelled is likely to send your premiums sky high for several years and you need to prevent that, which should be ok to do as you were clear with them when you asked them to quote that the incident was not yet resolved.0 -

I very much doubt that part0 -

If your policy premium increases because you might be at fault (unsettled claim) then you can get a pro rata refund for the extra premium you paid when the claim is settled in your favor. All your base are belong to us.0 -
You need to clarify this....only to have a phone call a few days later to say that they were cancelling my insurance due to the accident not being resolved (they also decided they would keep my deposit) ...........
I can now not afford to insure it through no fault of my own and also have to declare that I have been refused insurance......
You first tell us your insurance was "cancelled", then that you are telling other companies you have been "refused".
You say your cancellation was because your claim was unresolved.
Did you disclose this claim when applying for cover? If so then you have grounds for complaint as the insurer looks to have cancelled unreasonably - make a formal complaint and escalate to the FOS if you are unhappy with the reply.
But if you failed to disclose the claim then you look to be stuck.
A cancelled policy is on your record for ever, and usually has to be disclosed for ever.
If this is the case see if a local broker (not Swinton) can help.0 -
keep notes of all the interactions you have with your and the other parties insurance. Take quality legal advice if you feel you need it. better than a lot of well meaning non experts on a forum like this.0

How did you buy the policy?
What questions did you answer (exact wording) ? What answers did you give?
If it was via an aggregator like Confused.com did you check the data had transferred across correctly BEFORE buying?
An ongoing claim for Motor is not normally an issue with switching insurers however in most cases an outstanding claim is a fault claim until such time as its concluded because there is no guarantee the insurer will get their money back either due to a dispute in liability or because the TP turns out to be uninsured etc.
Your main course of action should be trying to argue against the cancellation/ refusal assuming you did give them the correct information0
