PCWorld agreed to exchange item, then ran out of stock, what can I do

  • I can say I want my item back (unless they make alternative acceptable/reasonable arrangements)
The actual contract was a laptop in the colour you requested and it could be argued it's not formed until you get the colour you wanted. They can't supply it so they cancelled the contract and refunded your money.
Contracts are formed when the retailer sends email saying they'll dispatch the order, not when you receive the correct item

Of course you rejected it! You contacted PC World and advised them they had sent you the wrong item and allowed them to collect it - thats rejecting it.

Since they cant find you a suitable replacement, they are going to refund you.

As stated, your options are to either claim "Loss of a bargain" or move on.

When I spoke to them I didn't say I wanted to return it. I didn't want to return it. I made this clear in the phone call.
I wanted to exchange it. This is what I said, and this is what was clearly agreed on. Hence the contract was one of exchange.
Like before people invented money people had to barter, right? Swap their thing for whatever they wanted. That was a contract for a swap/exchange of my cow for your 2 sheep. If I give you the cow and you can't give me the sheep, I get my cow back. Simple.
  • PC World can say they'll just refund me
As you can see from the advice it would appear you're barking up the wrong tree. All you're going to do is waste your time and make your life difficult and get yourself worked up over something where you've got it wrong.

And if it's out of stock you can legally force them to supply you with one?

Practically I can't, but they ought to feel obliged to supply me with a similar item which isn't on sale.

Yes I suppose you're right, I'm just trying to explain my point of view, but it does seem that most people don't look at it the same way as I do

    No they don't, that's ridiculous.

Just look at the results of your poll, you are the only voter, everybody else says a refund is a perfectly fair and reasonable outcome... What does that tell you?

Well they don't so deal with it.

OK lets give credit to PC World where credit is due...
Just spoke to a manager who agreed I can order the non-reduced item and they'll refund the difference.:j
Thanks for everyone's feedback and voting, the fact that everyone thought I was wrong (sniff) makes me more impressed with PC World so I'm happy to leave a good report on them.
